federal judge and united states attorney general for whom i always had a great deal of respect, michael mukasey. according to the report, no one breached their duty. no one is responsible. no identification of any one responsible for a failure. the only person identified as making any decision is the ambassador. what does that tell you? >> tells me that somebody deeply doesn't want to discuss who is responsible. what the report says in essence is mistakes were made but nobody who is still alive made them and that doesn't sound like a reasonable conclusion to me. >> judge jeanine: one of the things i was taken by was the wording "no one breached his or her duty." that sounded very legalistic to me and i wonder given the fact that the government generally has immunity because the king can do no wrong which means you can't sue the government and make none any that now we have this federal tort claims act. are they anticipating some lawsuits that they would use such specific language like that? >> i don't know that it is a matter of anticipating a lawsuit so much as it is a desire to avoid

the details. michael described it as it's not a palemic and i think audiences smell propaganda but if you can introduce the complexity of what they do. , 43-year-old michael ciporrani and 25-year-old, tomascz chip chip. the shooter, william spengler set the home ablaze and took his own life shooting himself in the head. spengler was no stranger to law enforcement. he served 16 years for a conviction of manslaughter beating his grandmother to death. as a ex-con, spengler was not permitted to have weapons. >> spengler was a convicted felon. he is not allowed to poe -- possess weapons. so did he legally possess the weapons? no. we've had all kinds of weapons larcenies in town and around the county and wayne county as of late so i don't know where those weapons came from but we'll certainly find out. >> reporter: why spengler went on the rampage there is still known motive. when the mother died two months ago, obit irwary asked for donations to the west webster fire department and that is who responded to the fire. he had a strained relationship with his sister. the massive fire that left seven homes destroyed made it difficult to search for what might be additional victims. jamie, it is possible we might learn more defails in the next f

a march of one million moms in washington, d.c., we spoke with kaseen reid in atlanta, and michael bloomberg coming out and condemning the nra statement that came out on friday. what is the baby step towards a solution here? really, is there the political will to get things done? >> i used to work for chuck schumer and he will be active on this issue. the baby step is to start treating them like automobiles. let's require insurance before you can register and own them. then the market will determine risk. people with higher risk will not be able to get guns and they will not be able to afford guns. if we stop with that. we can move away from big be round ammunitions. you will get a hard time getting insurance for a weapon that can cause more damage. we could keep it away from the government. let the private sector regulate it on its own. >>. >> the nra proposal that was put out is not far-fetched. a lot of schools have resource officers that provide an extra level of security. but you have to understand that there's 100,000 public schools in the country. do the math. >> 5 billion.

're getting holiday apologies from idaho republican senator michael crapo after he was arrested and charged with dui just outside of washington, d.c. arlington, virginia police said senator crapo was stopped after running a red light early sunday morning. he was arrested after failing a sobriety test. senator crapo released a statement apologizing for the incident saying in part, quote, i accept total responsibility and will deal with whatever penalty comes my way in this matter. i will also undertake measures to insure this circumstance is it never repeated. senator crapo is do due in court, january 4th, gregg. gregg: we're watching a situation with president h.w. bush this morning as we're awaiting for his release from a houston hospital. the 88-year-old president is undergoing treatment for a bronchitis related cough for over a month. last week his doctors said they hoped to have him home for the holidays. they since decided to hold off on final release date until the president, quote, built up all his energy. we certainly wish him well. heather: hope he does that soon and able to get ho
